Words to know this month:

  • Copyright
  • Public Domain
  • Fair Use

Copyright:

A legal right that grants creators exclusive control over their original works, such as books, music, and art, for a specific period, allowing them to decide how and when their creations are used.

  • Examples of works protected by copyright:
Paintings, photographs, illustrations, musical compositions, sound recordings, computer programs, books, poems, blog posts, movies, architectural works, plays, and more

Public Domain:

Works enter the public domain  when their copyright protection expires, is forfeited, or is otherwise deemed inapplicable, meaning they are free for anyone to use, adapt, or distribute without permission.

Most works enter the public domain due to the expiration of their copyright term.

  • Works published before 1923 are generally considered to be in the public domain.
  • For works published after 1977, copyright protection lasts for the life of the author plus 70 years.
  • For works published between 1923 and 1964, copyright protection may have been lost if the copyright owner failed to renew it in its 28th year.

Fair Use:

(in US copyright law) the doctrine that brief excerpts of copyright material may, under certain circumstances, be quoted verbatim for purposes such as criticism, news reporting, teaching, and research, without the need for permission from or payment to the copyright holder.

What are the 4 conditions of fair use?

1.The purpose and character of your use.
2.The nature of the copyrighted work.
3.The amount and substantiality of the portion taken.
4.The effect of the use upon the potential market.
